Succession & Estate Planning

Protecting Your Legacy. Planning for Tomorrow.

Estate planning is the process of deciding, while you are able to, what should happen to your property, your business interests and the people who depend on you. Where no plan exists, the outcome is determined by law and can take considerably longer to resolve.

We advise on planning before death and on administration afterwards, and we act in contested succession matters where a dispute has already arisen.

Frequently Asked Questions

What happens if someone dies without a will in Kenya?
The estate is dealt with under the rules that apply to intestate succession, and a grant of letters of administration is generally required before the estate can be distributed. The outcome may not reflect what the deceased would have chosen.
Who should inherit my property, and can I decide?
A validly made will allows you to set out your intentions, subject to the provisions of applicable law concerning dependants. We advise on how far your wishes can be given effect.
What happens to my business if I die?
That depends on how the business is owned and whether succession has been planned for in the constitutive documents and your will. Business succession planning addresses this in advance.
